These General Conditions govern purchases made through the B&W Break&Walk website. Please read them before placing an order. By completing a purchase, you accept these conditions in the version published at the time of the order.

For consumers resident in a Member State of the European Union, these conditions are intended to operate as a common EU distance-selling baseline. Nothing in these conditions limits or excludes any mandatory consumer rights that apply in the consumer's country of habitual residence.

1. Seller identification

The seller and owner of the products sold through this website is Gold Division S.L., with Spanish tax identification number B02997625 and registered address at C/ Xixona, 3, 03204 Elche (Alicante), Spain.

2. Scope and customers

These conditions apply to online sales of footwear, accessories and other products offered by B&W Break&Walk through this website, including sales to EU Member States made available at checkout. Purchases may be made by consumers who are at least 18 years old and have legal capacity to contract under the law applicable to them.

The customer is responsible for providing complete and accurate information during the purchase process. B&W Break&Walk may refuse or cancel orders where the information supplied is false, incomplete or prevents the order from being processed correctly.

3. Products and availability

B&W Break&Walk makes reasonable efforts to show product descriptions, photographs, sizes, colours and prices accurately. The main characteristics of the product form part of the pre-contractual information and of the contract. Minor differences may arise due to screen settings, photography or manufacturing tolerances, especially in colour perception, but this does not exclude B&W Break&Walk's responsibility for relevant errors in product information or lack of conformity.

Products are offered subject to availability. If a product becomes unavailable after the order is placed, B&W Break&Walk will inform the customer and will offer an alternative solution or a refund of the affected amount.

4. Purchase process and contract formation

To place an order, the customer must select the product, size and quantity, add it to the cart, review the cart, enter the requested contact, delivery and billing information, choose the available delivery and payment method, review the order summary and confirm payment.

Before confirming the order, the customer can review and correct the information entered in the cart and checkout. The contract is concluded when the customer confirms the order and the payment is accepted. B&W Break&Walk will send an order confirmation to the email address provided by the customer.

The contract may be concluded in the languages available on the website. B&W Break&Walk may store the order information in its systems. The customer can access order information through the confirmation email and, where applicable, through the customer account.

The customer may request cancellation of an order before it has been prepared or shipped by contacting B&W Break&Walk as soon as possible. Any operational cancellation period, including a 24-hour reference period, only applies to processing the order before dispatch and does not limit the consumer's statutory right of withdrawal after delivery.

5. Prices, taxes and promotions

Prices shown on the website are final retail prices and include VAT or applicable indirect taxes when required by law. Shipping costs, customs duties or other import charges, where applicable, are shown or calculated separately before the customer confirms the order.

Promotions, discount codes and free-shipping thresholds apply only under the conditions expressly indicated for each promotion. If a discount reduces the order below the applicable free-shipping threshold, shipping costs may apply.

6. Payment

The customer may pay using the payment methods available at checkout at the time of purchase. Payment is processed through secure payment providers. B&W Break&Walk does not store full card details.

If payment is rejected, the order will not be completed. B&W Break&Walk may perform security checks and may cancel orders where there are objective signs of fraud, misuse of payment methods or breach of these conditions.

7. Shipping and delivery

Orders are shipped to the destinations available at checkout. Estimated delivery times are working-day estimates and may be affected by carrier incidents, stock availability, promotional periods, customs procedures or force majeure events.

Orders over 50 EUR are shipped free of charge, except where the checkout or promotion terms state otherwise. Free shipping does not apply if the order total after discounts does not reach the required minimum.

For deliveries outside the European Union or to territories with special tax treatment, the customer may be responsible for customs duties, import taxes and other charges required by the destination authorities. These amounts are not controlled by B&W Break&Walk unless expressly included at checkout.

If the package appears damaged, opened or tampered with on delivery, the customer should report it to B&W Break&Walk as soon as possible, preferably within 24 hours, through the Contact Form, attaching photographs and any available evidence. This 24-hour reference is requested to help B&W Break&Walk manage the carrier claim and does not limit the customer's statutory rights if the damage, defect or lack of conformity is detected later.

8. Right of withdrawal

Consumers in the European Union have the right to withdraw from a distance purchase within 14 calendar days without giving any reason. For goods, the period starts on the day on which the consumer, or a third party indicated by the consumer other than the carrier, receives the goods. If the deadline expires on a non-working day in the applicable jurisdiction, the deadline may be extended to the next working day where mandatory law so provides.

To exercise the right of withdrawal, the customer must inform B&W Break&Walk of the decision to withdraw by an unequivocal statement before the withdrawal period expires. The customer therefore has 14 calendar days from delivery to communicate the withdrawal. The customer may use the Returns Portal, the Contact Form, or the model withdrawal form included below, although use of the model form is not mandatory.

After communicating the withdrawal, the customer has an additional period of 14 calendar days to send the goods back to B&W Break&Walk or to hand them over to the carrier.

In the event of withdrawal from the full order, B&W Break&Walk will refund the payments received from the customer, including the least expensive standard delivery cost offered for the original shipment where legally applicable. If the customer withdraws only from part of an order, the original delivery costs will not be refunded unless legally required or unless the remaining order no longer justifies those costs under applicable law. Supplementary delivery costs resulting from the customer's choice of a delivery method other than the least expensive standard delivery offered by B&W Break&Walk will not be refunded unless mandatory law requires otherwise.

The refund will be made without undue delay and in any event no later than 14 calendar days from the day on which B&W Break&Walk is informed of the withdrawal. B&W Break&Walk may withhold the refund until it has received the goods back or until the customer has supplied evidence of having sent them back, whichever occurs first.

The refund will be made using the same payment method used for the initial transaction, unless the customer expressly agrees otherwise and provided that no additional cost is incurred as a result.

The customer must send back the goods without undue delay and, in any event, no later than 14 calendar days from the date on which they communicate the withdrawal. Unless B&W Break&Walk indicates otherwise or the product is defective or non-conforming, the direct cost of returning the goods will be borne by the customer, provided that the customer was informed of that cost before the purchase as required by applicable law.

The customer is only liable for any decrease in value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning, as would be allowed in a physical shop.

9. Returns, exchanges and defective products

Return and exchange requests can be managed through the Returns Portal or through the Contact Form.

Voluntary exchanges may be subject to the conditions, destination limits and costs stated in the Returns and Replacements page or in the returns portal. These voluntary conditions do not affect statutory withdrawal rights or rights arising from defective or non-conforming products.

Returns will not be rejected merely because the outer shoe box or packaging has been used for transport or labelling. However, if the customer handles the product or packaging beyond what is necessary to check the nature, characteristics and functioning of the goods and this causes a real loss of value, B&W Break&Walk may apply a reasonable and justified depreciation, in accordance with applicable law.

If the product received is defective, damaged or does not conform to the contract, the customer should contact B&W Break&Walk as soon as possible through the Contact Form, attaching photographs and a description of the issue. B&W Break&Walk will review the case and provide the legally applicable remedy.

Where the product is defective or non-conforming, the return and remedy will be free of charge for the customer in accordance with applicable consumer law.

10. Legal guarantee of conformity

Products sold to consumers are covered by the legal guarantee of conformity applicable under EU consumer law and the national law that applies to the consumer. This guarantee covers lack of conformity with the contract and is not limited to manufacturing defects. EU rules provide a minimum legal guarantee of two years for new goods. Under Spanish law, new goods are generally covered for three years from delivery. If the mandatory law of the consumer's EU country of habitual residence grants broader protection, that protection will prevail.

If a product is not in conformity with the contract, the consumer may be entitled to have the product brought into conformity by repair or replacement free of charge, to a proportionate price reduction or to termination of the contract, under the legally applicable conditions.

The legal guarantee does not cover damage caused by misuse, normal wear and tear, lack of care, accidents or use contrary to the nature or instructions of the product.

11. Customer service and complaints

B&W Break&Walk will acknowledge and handle complaints as quickly as reasonably possible and, in any event, within the maximum period required by applicable consumer law. In Spain, complaints must generally be answered within a maximum period of one month, without prejudice to any shorter mandatory period that may apply.

Where legally required, consumers may request official complaint forms or submit complaints to the competent consumer authority. Consumers may also contact the competent consumer authorities, the European Consumer Centre in their country, or any out-of-court dispute resolution mechanisms available under applicable law. The former EU Online Dispute Resolution platform ceased operating on 20 July 2025.

12. Website use, intellectual property and liability

The website content, trademarks, designs, texts, images, logos and other materials are owned by B&W Break&Walk or by third parties who have authorised their use. The customer may use the website only for personal and lawful purposes and may not reproduce, distribute, modify or exploit its content without authorisation.

B&W Break&Walk is not liable for service interruptions, technical errors, security incidents or damages caused by third parties where they are outside its reasonable control, without prejudice to any mandatory liability established by law.

13. Privacy and cookies

Personal data processing is governed by the Privacy Policy. Use of cookies and similar technologies is governed by the Cookies Policy.

14. Applicable law and jurisdiction

These conditions are governed by Spanish law. For consumers resident in the European Union, this choice of law does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country where the consumer has their habitual residence, where those provisions apply under EU conflict-of-law rules.

If the customer acts as a consumer, any dispute will be submitted to the courts and authorities determined by the applicable consumer protection and jurisdiction rules. If the customer does not act as a consumer, the parties submit to the courts of Alicante, Spain, unless mandatory law provides otherwise.
